Terms and Conditions

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement (EULA). These documents collectively govern your relationship with the Developer regarding the App.

2. Eligibility

• You must be at least 16 years of age to use the App
• By using the App, you represent and warrant that you meet this age requirement
• If you are under the age of legal majority in your jurisdiction, you must have the consent of a parent or legal guardian
• The Developer reserves the right to terminate accounts that violate this requirement

3. Description of Service

Survai is a mobile application that provides:

• Offline Maps: Downloadable map data for offline use
• Map Pins: Ability to create and manage location-based markers with categories and notes
• AI Assistant: On-device artificial intelligence chatbot for informational purposes
• Mesh Networking: Bluetooth-based peer-to-peer data sharing between nearby devices
• Knowledge Base: Downloadable reference information database

Features may vary by platform (iOS/Android) and subscription tier.

4. Account and Device Registration

4.1 Device Registration

Upon first use, the App automatically generates a unique device identifier for your device. This identifier is used to associate your device with the App's services.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of any authentication credentials
• All activities that occur on your device in connection with the App
• Notifying us immediately of any unauthorized use

The Developer is not liable for any loss or damage arising from unauthorized access to your device or account.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

The App may offer both free features and premium subscription-based features ("Survai Pro"). Access to certain features may require an active subscription.

5.2 Payment Processing

All payments are processed through Apple App Store (iOS) or Google Play Store (Android). The Developer does not directly handle payment transactions. All billing inquiries should be directed to Apple or Google.

5.3 Subscription Terms

• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your device's account settings (App Store / Play Store)
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

5.4 Price Changes

The Developer reserves the right to modify subscription pricing. You will be notified of any price changes in advance through the respective app store. Continued use after a price change constitutes acceptance of the new pricing.

5.5 Refunds

Refund requests are handled by Apple App Store or Google Play Store in accordance with their respective refund policies. The Developer does not process refunds directly.

6. Acceptable Use

6.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms. The App is intended for personal, non-commercial use.

6.2 Prohibited Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Create or share false, misleading, or deceptive map pins or content, especially regarding safety-critical information (danger zones, water sources, medical aid, shelter)
• Use mesh networking to distribute harmful, abusive, harassing, or illegal content
• Attempt to exploit, hack, or gain unauthorized access to the App, its servers, or other users' devices
• Interfere with or disrupt the mesh networking protocol or other users' connections
• Use the App to collect or harvest information about other users
• Impersonate any person or entity
• Use the App in a manner that could endanger yourself or others
• Circumvent any usage limits, subscription requirements, or technical restrictions
• Use the App for commercial purposes, including advertising or solicitation, without prior written consent

6.3 Enforcement

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including without limitation, suspending or terminating access to the App, reporting to law enforcement, and pursuing civil remedies.

7. User-Generated Content

7.1 Content Ownership

You retain ownership of content you create (map pins, notes). By creating content within the App, you grant the Developer a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and distribute such content solely in connection with operating and improving the App.

7.2 Content Standards

All user-generated content must comply with these Terms. Content that violates these Terms may result in termination of your access.

7.3 No Moderation Guarantee

The Developer does not pre-screen, monitor, or moderate user-generated content, particularly content shared via mesh networking. We are not responsible for content created or shared by users. However, we reserve the right to remove content that violates these Terms when we become aware of it.

7.4 Mesh-Shared Content

Content shared via mesh networking is transmitted directly between devices. Once shared, the Developer cannot control, retrieve, or delete content from other users' devices. You understand and accept this limitation.

8. AI Assistant Terms

8.1 Nature of AI Content

The AI assistant uses third-party open-source language models running on your device. AI-generated responses:

• Are generated algorithmically and may contain errors, inaccuracies, or outdated information
• Do not constitute professional advice (medical, legal, safety, or otherwise)
• Should not be the sole basis for any decision, especially those affecting health or safety
• May vary in quality depending on the model selected and available device resources

8.2 Model Downloads

AI models are downloaded from third-party sources. These downloads may:

• Consume significant device storage (400 MB to 4+ GB per model)
• Consume significant mobile data if not on Wi-Fi
• Impact device performance during inference

You are responsible for managing your device storage and data usage.

8.3 No Liability for AI Content

The Developer shall not be liable for any loss, damage, injury, or death arising from reliance on AI-generated content. You use the AI assistant entirely at your own risk.

9. Offline Features and Data Download

9.1 Map Downloads

The App allows downloading map data for offline use. Downloaded maps:

• Are sourced from third-party providers and may not be completely accurate or current
• May consume significant storage space on your device
• Are provided for reference purposes only and should not be relied upon as the sole navigation tool

9.2 Knowledge Base

The downloadable knowledge base contains reference information. This content:

• May not be comprehensive, accurate, or up-to-date
• Is provided for informational purposes only
• Should not be relied upon in lieu of professional guidance or official sources

10. Mesh Networking Terms

10.1 How It Works

Mesh networking uses Bluetooth Low Energy (BLE) to create peer-to-peer connections between nearby devices. When enabled, your device may automatically discover and exchange data with other devices.

10.2 User Acknowledgments

By using mesh networking, you acknowledge and agree that:

• Your map pins and associated data may be shared with nearby devices
• You may receive data from unknown or unverified sources
• The Developer cannot verify the identity of other mesh network participants
• Data integrity cannot be guaranteed in peer-to-peer transmissions
• The Developer has no ability to monitor, control, or moderate mesh communications
• You should independently verify any information received via mesh networking before acting on it

10.3 Battery and Performance

Mesh networking may significantly impact battery life and device performance. The Developer is not responsible for any impact on your device's battery or performance.

11. Intellectual Property

11.1 Developer Property

The App and its original content (excluding user-generated content and third-party components), features, and functionality are owned by the Developer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11.2 Third-Party Components

The App incorporates third-party open-source software and data, including but not limited to MapLibre, OpenFreeMap, and various AI models. These components are subject to their respective licenses.

11.3 Feedback

If you provide feedback, suggestions, or ideas regarding the App, you grant the Developer an unrestricted, irrevocable, perpetual, royalty-free license to use such feedback for any purpose without obligation to you.

12. Disclaimer of Warranties

THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY. THE DEVELOPER DOES NOT WARRANT THAT:

• THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
• THE APP WILL BE AVAILABLE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS OBTAINED FROM THE APP WILL BE ACCURATE, RELIABLE, OR COMPLETE
• ANY ERRORS IN THE APP WILL BE CORRECTED
• THE APP IS SUITABLE FOR USE IN SURVIVAL, EMERGENCY, OR SAFETY-CRITICAL SITUATIONS

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY PERSONAL INJURY, BODILY HARM, OR DEATH ARISING FROM USE OF THE APP
• ANY DAMAGE ARISING FROM RELIANCE ON AI-GENERATED CONTENT, MAP DATA, OR LOCATION INFORMATION
• ANY DAMAGE ARISING FROM CONTENT RECEIVED VIA MESH NETWORKING
• ANY DAMAGE ARISING FROM INTERRUPTION, SUSPENSION, OR TERMINATION OF THE APP
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR DATA

THE DEVELOPER'S MAXIMUM AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO THE DEVELOPER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50.00).

14. Indemnification

You agree to defend, indemnify, and hold harmless the Developer and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of and access to the App
• Your violation of any term of these Terms
• Your violation of any third-party right, including intellectual property rights
• Your user-generated content
• Any damage caused to a third party arising from your use of the App
• Any actions taken based on information provided by the App

15. Third-Party Links and Services

The App may contain links to or integrate with third-party services. The Developer does not control and is not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

16. Modification and Availability

16.1 Modifications to the App

The Developer reserves the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. The Developer shall not be liable to you or any third party for any modification, suspension, or discontinuation.

16.2 Modifications to Terms

We may revise these Terms at any time by posting an updated version. Changes are effective immediately upon posting. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

16.3 Service Availability

The Developer does not guarantee continuous, uninterrupted access to the App. The App may be unavailable due to maintenance, updates, server issues, or factors beyond our control.

17. Termination

17.1 Termination by You

You may stop using the App at any time. To terminate your relationship with the Developer, delete the App from your device and, if applicable, cancel any active subscriptions.

17.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

17.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• You must delete the App from your device
• The Developer may delete your data from its servers
• Provisions that by their nature should survive (including warranty disclaimers, limitation of liability, and indemnification) shall survive termination

18. Force Majeure

The Developer shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of governmental authorities, fire, floods, accidents, strikes, pandemics, or shortages of transportation, facilities, fuel, energy, labor, or materials.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and the Developer regarding your use of the App and supersede all prior agreements and understandings.

22. No Waiver

The failure of the Developer to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by the Developer.
